1. Acceptance of Terms

These Terms constitute a legally binding agreement between you and Sell For One.

If you do not agree to these Terms, you must immediately cease using our services and refrain from accessing our website or contacting our representatives.

By engaging our services, scheduling consultations, or entering into any listing agreement with Sell For One, you confirm your acceptance of these Terms in their entirety.

2. Service Description

Sell For One provides real estate listing services designed specifically for cost-conscious property sellers. Our services include, but are not limited to:

A. 1% Listing Program: A comprehensive real estate listing solution with a one percent commission structure, offering professional marketing, listing management, and representation throughout the selling process.

B. Seller Savings Planning: Consultation and strategic planning services to help sellers maximize their net proceeds through cost-effective selling strategies and financial planning related to real estate transactions.

C. Listing-to-Close Support: Ongoing support and guidance throughout the entire transaction process, from initial listing through closing, including coordination with buyers, agents, title companies, and other parties involved in the transaction.

All services are subject to separate written agreements, including listing agreements that will specify the exact terms, conditions, and scope of services for each individual transaction. These Terms of Service supplement and do not replace any executed listing or service agreements.

The Company reserves the right to modify, suspend, or discontinue any service at any time without prior notice. Service availability may vary based on property location, market conditions, and individual circumstances.

3. User Obligations

By using our services, you agree to:

A. Provide accurate, complete, and truthful information regarding yourself, your property, and any matters relevant to the real estate transaction. You acknowledge that providing false or misleading information may result in termination of services and potential legal consequences.

B. Maintain the confidentiality of any account credentials, login information, or secure access provided to you by Sell For One.

C. Respond promptly to reasonable requests for information, documentation, or action necessary to facilitate the real estate transaction.

D. Comply with all applicable federal, state, and local laws, regulations, and ordinances related to the sale of real estate, including but not limited to fair housing laws, disclosure requirements, and zoning regulations.

E. Maintain your property in showing condition and provide reasonable access for showings, inspections, and appraisals as outlined in any listing agreement.

F. Not interfere with or disrupt the services, servers, or networks connected to our business operations.

G. Not use our services for any unlawful purpose or in any way that violates these Terms.

H. Disclose all material facts about your property that may affect its value or desirability to potential buyers.

I. Refrain from directly or indirectly circumventing our services by independently contacting buyers introduced through our marketing efforts during the term of any listing agreement and for any protection period specified therein.

Failure to comply with these obligations may result in immediate termination of services and may affect your obligations under any executed agreements.

4. Appointment Scheduling and Cancellations

A. Scheduling: Appointments for consultations, property evaluations, strategy sessions, or other services may be scheduled by contacting Blair.Dane@sellforone.info or through other scheduling methods as may be made available by the Company. All appointments are subject to availability and confirmation.

B. Confirmation: You will receive confirmation of scheduled appointments via email or other agreed-upon communication method. It is your responsibility to verify appointment details and notify us immediately of any discrepancies.

C. Cancellation Policy: If you need to cancel or reschedule an appointment, you must provide notice as soon as possible by contacting Blair.Dane@sellforone.info. While we strive to accommodate schedule changes, repeated cancellations or no-shows may result in limitations on future scheduling or termination of services.

D. Company Cancellations: Sell For One reserves the right to cancel, reschedule, or modify appointments due to emergencies, agent availability, or other unforeseen circumstances. We will make reasonable efforts to notify you promptly and reschedule at your convenience.

E. Late Arrivals: If you arrive more than fifteen minutes late to a scheduled appointment without prior notice, the appointment may be treated as a missed appointment and subject to rescheduling.

F. Virtual Appointments: For virtual consultations, you are responsible for ensuring adequate internet connectivity and appropriate technology. Technical difficulties on your end do not constitute grounds for service modifications or fee adjustments.

5. Payment Terms

A. Commission Structure: The specific commission rate, structure, and payment terms for listing services will be clearly outlined in your individual listing agreement. The 1% listing commission advertised represents our standard offering but may be subject to minimum fees, transaction requirements, or adjustments based on property value, location, or service level selected.

B. Additional Fees: Certain services, marketing enhancements, or third-party costs may require additional fees beyond the standard commission. Any such fees will be disclosed and agreed upon in writing before being incurred.

C. Payment Timing: Commission and fees are typically payable at closing from the proceeds of the sale. In the event a transaction does not close due to seller default or withdrawal as defined in the listing agreement, you may be responsible for fees incurred as specified in that agreement.

D. Third-Party Costs: You acknowledge that certain costs associated with selling real estate, including but not limited to title insurance, transfer taxes, recording fees, repairs, inspections, and staging, are separate from our service fees and are your responsibility unless otherwise agreed in writing.

E. Cooperative Compensation: Our commission structure typically includes compensation to be offered to buyer agents. The specific arrangement will be detailed in your listing agreement and complies with all applicable regulations and industry standards.

F. Refunds: Commission refunds or adjustments are not provided except as may be specifically outlined in your listing agreement or as required by law.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

A. Sell For One, its owners, agents, employees, contractors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of our services, including but not limited to lost profits, lost sales, property damage, or emotional distress.

B. Our total aggregate liability for any claims arising out of or relating to these Terms or our services shall not exceed the total amount of commission actually paid to and received by Sell For One in connection with the specific transaction giving rise to the claim.

C. We are not liable for delays, failures, or interruptions in service delivery caused by circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, government actions, labor disputes, internet or utility failures, or third-party actions.

D. We are not responsible for the actions or omissions of third parties, including but not limited to buyers, buyer agents, inspectors, appraisers, lenders, title companies, contractors, or other service providers involved in your transaction.

E. While we strive to market your property effectively, we make no guarantees regarding the timeline for sale, the final sale price, or the number of offers you may receive. Real estate market conditions vary and are affected by numerous factors outside our control.

F. We are not liable for any losses resulting from your failure to disclose material information, comply with legal requirements, or follow professional advice provided during the transaction.

G. Any claims against Sell For One must be brought within one year from the date the cause of action accrues, or such claim shall be permanently barred.

H. You agree that these limitations of liability reflect a reasonable allocation of risk and are a fundamental element of the bargain between you and Sell For One.

7. Warranty Disclaimers

A. Services Provided "As Is": All services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

B. No Guarantee of Results: We do not warrant or guarantee that your property will sell, that it will sell within any particular timeframe, that it will sell at any particular price, or that you will receive any specific number of offers or showings.

C. Market Advice: Any opinions, estimates, market analyses, pricing recommendations, or other advice provided by Sell For One representatives are based on professional judgment and available information but are not guarantees of actual results. Market conditions change constantly and actual outcomes may differ significantly from projections.

D. Third-Party Content: We disclaim all responsibility for the accuracy, reliability, or legality of any third-party information, services, or content that may be referenced or utilized in connection with our services.

E. Technology: We do not warrant that our website, communication systems, or technology platforms will be uninterrupted, secure, or error-free, or that defects will be corrected.

F. Legal and Tax Advice: Sell For One provides real estate services only. We do not provide legal, tax, financial, or other professional advice. You are encouraged to consult with appropriate licensed professionals regarding legal, tax, and financial matters related to your real estate transaction.

G. Property Condition: We make no representations or warranties regarding the condition, value, or fitness of your property. Any information about property condition should be verified through appropriate inspections and professional evaluations.

H. Regulatory Compliance: While we strive to comply with all applicable laws and regulations, you remain responsible for ensuring your own compliance with all legal requirements related to property ownership and sale.

8. Governing Law

These Terms of Service and any disputes arising out of or related to these Terms or the services provided by Sell For One shall be governed by and construed in accordance with applicable federal law and the laws of the jurisdiction where the property subject to services is located, without regard to conflict of law principles.

Any legal action or proceeding related to these Terms or our services must be brought exclusively in the courts having jurisdiction over the location where the property is situated, and you consent to the personal jurisdiction of such courts.

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect to the maximum extent permitted by law.

These Terms, together with any executed listing agreement or service agreement, constitute the entire agreement between you and Sell For One regarding the subject matter herein and supersede all prior or contemporaneous understandings, agreements, or representations, whether oral or written.

9. Indemnification

You agree to indemnify, defend, and hold harmless Sell For One, its owners, agents, employees, contractors, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney fees) arising out of or related to:

A. Your breach of these Terms or any listing or service agreement;

B. Your violation of any law, regulation, or third-party right;

C. Any inaccurate, misleading, or fraudulent information you provide;

D. Any failure to disclose material facts about your property;

E. Your property's condition, including any personal injury or property damage occurring on the property;

F. Any dispute with buyers, other agents, or third parties related to your transaction;

G. Your use or misuse of our services.

This indemnification obligation shall survive the termination of these Terms and any service relationship.

10. Intellectual Property

All content, materials, trademarks, service marks, logos, and intellectual property associated with Sell For One and our services, including but not limited to marketing materials, website content, photographs, brochures, and promotional materials, are owned by or licensed to Sell For One and are protected by copyright, trademark, and other intellectual property laws.

You may not use, copy, reproduce, distribute, modify, or create derivative works of any Company intellectual property without express written permission. Upon termination of services, you must cease all use of Company intellectual property.

Marketing materials created specifically for your property listing may be used by Sell For One for promotional purposes unless you specifically object in writing.

11. Privacy and Data Use

Your privacy is important to us. We collect and use personal information in accordance with applicable privacy laws and regulations. By using our services, you consent to our collection and use of information as necessary to provide services, including:

A. Contact information for communication purposes;

B. Property information for marketing and transaction purposes;

C. Financial information as necessary for transaction processing;

D. Any other information you voluntarily provide.

We will not sell your personal information to third parties but may share information with service providers, cooperating agents, and others as necessary to facilitate your real estate transaction.

You are responsible for the accuracy of information you provide and for updating information as necessary.

12. Communication and Notices

A. Electronic Communication: By using our services, you consent to receive communications from us electronically, including via email, text message, or through online platforms. You agree that all electronic communications satisfy any legal requirement that communications be in writing.
